Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Psicoespacio ("Psicoespacio", "we", "us", or "our") and govern your access to and use of the Psicoespacio mobile and web application, websites, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old (or 16 in the EEA/UK) to use the Service. If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian's permission.

Psicoespacio is a personal-growth community offering structured lessons, live and scheduled events, a social community (threads, comments, profiles), a member map, and a gamification system (points, levels, achievements, ranking). Some features are free and others require a paid subscription.

The Service is provided for educational and self-development purposes only. It is not a substitute for professional psychological, psychiatric, medical, or therapeutic advice, diagnosis, or treatment. If you are in crisis or need professional help, contact a qualified provider or emergency services.

You are responsible for: (i) providing accurate registration information; (ii) keeping your password and account credentials secure; (iii) all activity that occurs under your account; and (iv) promptly notifying us of any unauthorized use. You may not create more than one account, share your account, or impersonate another person. We may suspend or terminate accounts that violate these Terms.

"User Content" means anything you post or upload to the Service, including threads, comments, reactions, images, videos, profile information, and location. You retain ownership of your User Content. By submitting User Content, you grant Psicoespacio a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, adapt, and distribute that content for the purpose of operating, promoting, and improving the Service.

You represent and warrant that:

• You own or have the necessary rights to your User Content.
• Your User Content does not violate any third-party rights or applicable law.
• Your User Content is not unlawful, defamatory, obscene, hateful, harassing, threatening, fraudulent, sexually explicit, or otherwise objectionable.

We may remove or restrict any User Content at our sole discretion and without notice, particularly content that violates these Terms or that we believe may harm the community.

You agree not to, and not to attempt to:

• Harass, bully, threaten, dox, or discriminate against any user.
• Post spam, scams, pyramid schemes, or unauthorized advertising.
• Offer or solicit clinical, medical, or therapeutic services through the Service.
• Upload malware, viruses, or any code designed to interfere with the Service or other users' devices.
• Scrape, crawl, reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law.
• Manipulate the gamification system (points, levels, ranking), use bots, or create fake accounts to gain advantage.
• Circumvent any access restrictions, security measures, or rate limits.
• Use the Service to violate any law or the rights of any third party.

Certain features of the Service are available through paid subscriptions. When you purchase a subscription:

• Billing. Payment is charged through the platform you used to subscribe (Apple App Store, Google Play, or our web payment processor). Subscription management is handled in part by RevenueCat, our subscription infrastructure provider.
• Auto-renewal. Subscriptions automatically renew at the end of each billing period (monthly or annual, as selected) at the then-current price, unless cancelled at least 24 hours before the end of the current period.
• Price changes. We may change subscription prices. Any price change will take effect at the start of your next billing cycle and, where required by law, we will notify you in advance and give you the option to cancel.
• Taxes. Prices may exclude applicable taxes, which will be added where required.

We may offer free trials. Unless you cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee. Only one free trial per user is permitted.

You can cancel your subscription at any time:

• iOS: Settings → [your name] → Subscriptions → Psicoespacio → Cancel.
• Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions → Psicoespacio → Cancel.
• Web: Settings inside the app, or email carlosperezpsicoespacio@gmail.com.

Cancellation takes effect at the end of the current billing period; you keep access until then. Except where required by applicable law, payments are non-refundable and we do not provide refunds or credits for partially used periods. Refund requests for purchases made through Apple or Google must be submitted through the respective platform.

The Service, including its software, design, text, graphics, logos, lessons, and other materials (excluding User Content), is owned by Psicoespacio or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

You may not copy, modify, distribute, sell, lease, or create derivative works of any part of the Service, nor use our trademarks, logos, or brand without our prior written permission.

The Service relies on third-party providers, including Apple, Google, Supabase, RevenueCat, OneSignal, Lovable Cloud, and Despia. Your use of those services through the Service may also be subject to their own terms and privacy policies. We are not responsible for the content, policies, or practices of third-party services.

You may stop using the Service at any time and delete your account by following the steps in our Privacy Policy. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will continue to apply.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION.

Content shared in the Service, including from other users and from Psicoespacio, is for informational and educational purposes only and is not professional advice. You are solely responsible for any decisions you make based on information from the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSICOESPACIO AND ITS OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

You agree to defend, indemnify, and hold harmless Psicoespacio from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

These Terms are governed by the laws of Spain, without regard to its conflict of laws principles. Before filing a formal claim, you agree to first contact us at carlosperezpsicoespacio@gmail.com and try to resolve the dispute informally for at least 30 days. If we cannot resolve it, you and Psicoespacio agree that any dispute will be resolved in the competent courts located in Spain, unless mandatory consumer-protection laws of your country of residence grant you the right to bring proceedings in another forum.

If you downloaded the Service from the Apple App Store, these Terms are between you and Psicoespacio only, not with Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Any claims relating to the Service, including product liability and intellectual-property claims, are governed by these Terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you downloaded the Service from Google Play, you acknowledge that Google is not a party to these Terms and is not responsible for the Service. Your use of the Service must also comply with the Google Play Terms of Service. Refunds for Google Play purchases are subject to Google's policies.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and notify you in the app or by email at least 30 days before the changes take effect, unless the changes are required to comply with law, in which case they may take effect immediately. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
